Why don't you try selling Andy Warhol prints online and let us know how that goes? The Beasties are obviously approaching the sample as intellectual property - note that they cleared use of the sample through ECM - and Mr Newton's problem seems to be that they didn't bother asking him, the copyright holder. Most of his rant is reserved for the judge, for dismissing non-notated sound as unoriginal. I don't think James Newton is the Second Coming of John Coltrane, but he did compose and perform the music sampled, and it has to be galling to see someone take your own work and make heaps of money from it. Granted, he was sailing against a tide of legal precedent, but I don't think he's completely wrong.
