Court turns down records demand in sex case
A Utah man accused of sexually assaulting his granddaughter at knife point has lost his bid to obtain records of interviews conducted by social workers with other family members. U.S. District Judge Ted Stewart threw out a subpoena for the records that was served on a social worker for the Navajo Nation, where the alleged crime occurred. Stewart ruled that although the Major Crimes Act authorizes the government to prosecute certain offenses that occur on reservations, tribes still retain sovereign immunity and can refuse to turn over the documents. The defendant, who maintains his innocence, contends the records contain evidence that could clear him.
