I appreciate hearing from you. As you may know, Congress first established the Renewable Fuel Standard (RFS) with the enactment of P.L. 109-58, the Energy Policy Act of 2005. The RFS seeks to foster greater use of fuels made from plants by establishing minimum volumes of various types of renewable biofuels, including ethanol, which must be included in the national supply of fuel used for transportation. The initial RFS established by P.L. 109-58 mandated that a minimum of 4 billion gallons of renewable fuel be used in 2006, with an increase to 7.5 billion gallons by 2012. However, in 2007, Congress approved and the President signed into law P.L. 110-140, the Energy Independence and Security Act of 2007. This law greatly expanded the renewable biofuel mandate volumes and prolonged the increase through 2022. This expanded RFS required the annual use of 9 billion gallons of renewable biofuels in 2008, with an increase to 36 billion gallons in 2022, including at least 16 billion gallons from cellulosic biofuels, and a cap of 15 billion gallons for corn-starch ethanol. Subsequently, the Environmental Protection Agency (EPA), which is responsible for administering the RFS, recognized that full compliance with the RFS mandate, as outlined in P.L. 110-140, poses significant challenges due to the recent fall in demand for gasoline. You should know that P.L. 110-140 permits the EPA to waive or modify the RFS mandate if certain economic conditions prevail. Accordingly, the EPA finalized a rule to decrease the target volume of renewable fuels used in gasoline and diesel fuel produced or imported in 2014, 2015, and 2016 to 16.28 billion, 16.93 billion, and 18.11 billion gallons respectively. This is compared to the respective levels of 18.15 billion, 20.5 billion, and 22.25 billion gallons, which were originally required by P.L. 110-140 for gasoline and diesel fuel produced or imported in 2014, 2015, and 2016. Additionally, in response to this situation, there have been several measures introduced in the 114th Congress that would modify the RFS. For example, Rep. Goodlatte has introduced H.R. 704, the RFS Reform Act, which would decrease the volume of renewable fuel that is required by P.L. 110-140 through 2022, and would eliminate the separate advanced biofuel volume requirements for those years. Additionally, the measure would cap the amount of ethanol that can be blended into conventional gasoline at 10 percent by volume. H.R. 704 was referred to the House Committee on Energy and Commerce, where it is currently pending consideration.
