To be more specific, navigation-constrained traffic has right of way - "Rule number 9 – Narrow Channels, Inland," as well as the 'law of tonnage', both summarized well here: https://americanboating.org/bigger_on_the_water.asp The latter still applies out in the middle of the ocean where Rule 9 might not. Also, commercial fishing vessels actively fishing, even small ones, often have RoW where other craft would not. I'm not familiar with commercial marine insurance, but would it cover the loss of a sailboat and possible injury liabilities if the sailboat actually had a legal right-of-way? That wouldn't work with auto insurance.

If he damages his vessel by hitting rocks, or running aground trying to avoid you, the cost of an inspection and loss of income from missed trips till repairs are made can be appreciable.
However, if he hits you and sinks you, his insurance will cover the loss of your vessel, which in this case is very minor compared to the potential costs he risks if he damages his vessel trying to avoid you.

Sinking you is the big ships Captain's cheapest and easiest solution in a tight channel.
